question about emmancipation in new york

ok some of you know what has happened with my daughter…well her b/f is having a lot of problems at home because of it…he wants to be there for my daughter and everything.his parents are being unreasonable and wont let him see his friends or go anywheres.he needs to know the laws and stuff about emancipation.I have been looking on the internet and getting old stuff what are the laws and how does he go about it?thank you

From what I understand, there is no court proceeding in New York State to become “emancipated”. It is a status that is received when people meet certain requirements ie.

* The youth must be living apart from his/her parents;
* The youth must be self supporting (may be receiving public benefits or child support if required by court order);
* The youth is not in need/receipt of foster care;
* The youth is living beyond the custody and control of the parent;
* The youth is over the age of 16.
