Will he be able to take my little girls from me?

I am going through a divorce. we have two children together he is in Iraq and he gets back in state soon he wants to keep our little girls for 5 months with his girl friend. what should I do? I’ve allready said no because they are way to young to go back and forth. But he said he is taking me to coart if I dont let him? Will he be able to take my little girls from me? Just because im being protective Parent?Thanks

I agree with ichibanarky. In most cases the courts will award custody to the mother unless she is unfit in some way. However most likely he will get to have visitation with his kids (what the courts refer to as joint custody). Normally the visitation is every other weekend and a day a week. It would be unlikely for him to get full custody or be allowed to have 5 full months with the girls. You should take him to court first…go after child support and custody. If you don’t he will.

If you’ve been the sole caregiver for the past little while (as he’s been in Iraq), then chances are pretty good the court will award you custody - even considering he may not always be there to care for them due to his career.

They might do joint custody, but without knowing your circumstances, we can’t say for sure.

You should take initiative and take him to court instead - show the court that you really want your girls.

First of all your ex husband is an butt for wanting to take the 5 month old baby back and forth.Second if you can prove to the judge that you are taking care of the girls then he cant get custody but he can get visitation rights.
