What is the burden of proof necessary to win a civil trial?

Answer #1

In civil suit, burden is on the plaintiff on what he has alleged. It depends upon the pleadings, assuming that the pleadings are drawn up properly and in conformity with the settled law on the subject. Plaintiff can succeed on the strength of his own case and not on the defendant’s weakness.
