Risks of letting seller stay in house after closing.

If you do let someone stay after closing, you need to have contract provisions to manage your risk by obligating the other side to take care of your property, make repairs to their damages, and to pay rent for the period they remain. A good real estate attorney can assist you in drafting good contract provisions to manage and assist with this risk, if you decide to allow it.

Dear bobbi, The fact that you are asking tells me you know there probably is a danger here and you know it. Once you take over ownership and allow them to stay then you are taking on the responsibility of their actions while they are there under your name. Since we don’t know the terms of your agreements with them you do face a danger of their actions in many ways. Maybe they’ll have a big party and this could result in damage? They leave the heat on at 90 with the door open…your bills right? If you know they will need to stay for reason perhaps a contract drafted making them responsible for damage, bills etc. during their 48 hours they are there under your name. Sue…good luck

With the house being in ur name what ever they do if they mess it up then u will end up in court to get it fixed. And then u better have pics of what it looked like before u signed the papers. I got lucky with mine they just needed a few more days to get out and there was no damage done. It really depends on what reasons they had to sell if they mess anything up.
