Moving state with my son

Hi was just wondering if anyone can help me. Im in adelaide and I have a son from a previous relationship, my new partner , son and I want to move to queensland as I want to work there. Do I need permission from his father to move state? There are no court orders and even though he denies it family and friends know he was abusive to me but as I have no proof he sees his son twice a week much against my will. Any help would be great

You don’t need his permission since there are no court papers. Although a lot of times the courts would let you do it since you are trying to find work there. The only major problem you will have is when he wants to see his son. You might however run into some problems with the visitation. If he wants to he can take you to court and force you to bring your son back to see him. However if he does this then most likely his visitation will go to every other weekend.

I suggest that you contact the domestic relations office where you live to ask their opinion but as I’ve said I don’t see how he can stop you without taking you to court.
