Emancipation in illinois!!!

Help!!! I want out!!! Ok I am 17 years old and I live in illinois. I will be 18 in 3 months. My life at home is terrible. My brothers do watever they want and they are younger than me and they beat up my mom and do drugs. Im the good kid and my mom treats me like crap. I even have pseudoseizures from stress because im there. It is physically and emotionally hurting me, theres more I just cant type it all. I am dating a 28 year old. My question is- if I live with his sister and get paid from the state to watch her kids can I be emancipated? And if so can my parents fight it and how long would it take? Thank you.

It is very unlikely that you will be able to get emancipated. And absolutely not before you turn 18.

How do I get emancipated?

There are actually three ways a minor may become emancipated:

Get married Join the military, or Go to court and have the judge declare you emancipated (“judicial declaration”).

Do I need my parents’ consent to get emancipated? Generally, yes. Minors who are not emancipated need parental consent to get married. In addition, minors who wish to marry must obtain the consent of a judge. Likewise, to join the military, a minor needs parental consent. To get emancipated by a judge, a minor must give his/her parent(S) notice of the court hearing, and the parent(S) may go to court to contest the emancipation. Through it all, keep a good relationship if at all possible, with parents, you need each other.

You can not collect money from the state and be emanicpated. Emancipation would be a long process and unless there is a clear and present danger to yourself in that house hold you can not speed up the process.

try to stick out the 3 months, you stuck out the 18 years so 3 months will be a breeze

thanks but they will fight it. so how long will the court stuff take? and a judge can give the consent for marriage? and my dad is a cop in my small town can that affect it?
