I need help writing a legal statement about why my ex husband should not have legal custody of my child

Fighting a custody battle is lengthy and complicated. Its best to obtain a lawyer in a situation like this.

To obtain “sole custody” where the children live with you full time/all year round is very difficult to obtain. Trust me - I went through a two year battle to gain custody of my daughter.

You would have to have valid and factual reasons stating why he would be unfit to keep the children. I think too often in situations such as this children can be used as pawns (I am by no means stating that this is what you are doing).

If he was abusive and you have police reports, pull those and submit those as evidence, and really take time to write your letter and keep it professional, do your best to leave your emotions out of the situation and stick to strictly the facts.

Also - Be prepared for a lengthy battle. Custody battles such as yours do not end quickly … I will however say, it took me two years and almost $40g, but I do not regret it as I know each night when I tuck my daughter in, that she is safe and I’ve kept her from a real danger.

I had gotten full legal and physical custody of mine and was even granted to move out of state(1, 000 mi) away from him where the kids had family from both sides. Obtain a lawyer…each state has their own laws and it should speak for itself as to why…just be honest!
