Are they considered common law?

If my sister and her boyfriend lived here at home with my parents for 4 years paying rent are they considered common law?

Do they share a bedroom?

If they are living in a house together and enacting a relationship, then they are common-law.

If they have separate rooms and pay separate rents, then they are roommates.

It depends on the state. In some states “common law” is based on the number of years they have co-habitated (7 years kinda sticks in mind)…in some states, it’s based on common ownership of property…Check out your state’s laws.

Ok, I’m basing this on Canadian law (where the asker is from), and here it’s one year of living under the same roof in a committed relationship…property is irrelevant unless they are going through a court separation.

If they do taxes together and she uses his last name and they have lived together for 6 years then YES they are commonly married,but it varies from state to state
