Null and void child adoption?

Me and my common-law husband have been together for 3 years and I would love nothing more than to adopt his two small boys. Their biological mother left when the youngest was 7 months old (almost 5 now) and has not seen them sense. So basically, they see me as their mother.

So my questions are…

  1. Would we have to have a marriage certificate for me to adopt them?
  2. Would we have to find her so she would have to sign over her rights since we have no clue where she is?
  3. Could he still pursue her for child support after the adoption? Or does adoption make it null and void?

Adoption teminates any kind of child support starting the day the child is adopted, you can however go after her for back child support. In most cases you need that person to give up their rights. Go talk to a lawyer and see what you can do. Goodluck.

  2. Would we have to find her so she would have to sign over her rights since we have no clue where she is? No. You could set a process to terminate rights on the basis of abandonment or whatever

  3. Could he still pursue her for child support after the adoption? Or does adoption make it null and void? Uhm, the adoption makes it null and void. Also, if he doesnt have a court ordered child support, I dont think you can pursue her for that…
