If this 23 year old is a teacher, and the 17 year old is his pupil, there are serious dangers for the teacher.
. The 17 year old may ( mistakenly ) think and believe that s/he has given free consent for sexual activity to occur, but the law identifies that this is a “position of trust” in which there is an “imbalance of power” ….. . ….. to the extent that the pupil may have been pressured into agreeing to the sexual activity - in much the same way as they agree to other instructions such as “do this homework” or “please pay attention while I am speaking”. . The private thing? Simple - a man and wife cannot be prosecuted for having consensual sex in private on their bedroom floor, but they can be prosecuted for having consensual sex in public on a shop floor. It would not be räpe or sexual abuse, but it would be illegal under indecency laws.

it really depends on your states laws. since your still teniqually a minor untill your 18 years old, theres a possibility he could go to jail since hes quite a few years older, but it really depends on your individual states laws and im not sure about them

its a uk law, not a ‘state law’ and it states anyone over the age of 16 cna have consensual sex, how old he is is up to you, theres no law about if your partner is older than you. Dont worry about anything legally stopping your :)
