Who knows Ohio law?

If a person is sentenced to stated prison term of 2 years and then gets sentenced to 6 months does the six months count under stated prison term? If not, can somebody please tell me if a person is sentenced to 2 years six months when is the earliest they can be released?

Answer #1

I don’t understand the question but if you are saying someone was arrested and served 6 months in jail before being sentenced to 2 years, then yes, the 6 months he spent in jail before the sentencing will count towards the 2 years as long as he was in jail for the crime he was sentenced for. This is a very vague question and cannot be answered correctly without more information. The judge may sentence someone to 2 years but make it an active sentence for maybe 1 year and then 1 year probation or any combination of active time and probation or just all probation.
