Am I going to have to go to court?

I’m a 19 year old girl and I never get in trouble with police EVER, so I don’t know the rules or what anything means.

Tonight was a very rainy night, and my friend and I were on our way to the movies, when I saw two cop cars up ahead. Of course I slowed down to maybe about 25 since it looked like someone just got pulled over, and no one was blocking the street, and out of nowhere a cop who was directing traffic ( there had been a minor accident, but you couldn’t really tell, and there weren’t any other cars there at the moment) popped out of nowhere, I didn’t see him at all, and I slammed on my brakes and hydroplaned which caused me to almost hit him (but it wasn’t really THAT close of a call). I then stopped and the one other cop asked to pull over, and was very gentle. Then the cop who I didn’t see came over, yelled at me, and told me he should throw my a$$ in jail and walked away. The other cop then said that since they were busy with the accident that if the officer decided to give me a “summons for not obeying officer” I would get it in the mail. How long does that take?

I have to wait to see if he’s going to do something, but what would happen? Doesn’t a summons mean like suing? Am I going to have to appear in court, or am I just going to have to pay a ticket? I really don’t know! The guy was pretty angry, REALLY ANGRY at me and rightfully so, but I wasn’t driving recklessly, or speeding, I just hydroplaned on a very rainy night and couldn’t see. What is the worst that will happen to me?

Don’t cross your bridges before you get to them! Another words, don’t worry about it until and unless you do get a summons in the mail.

If you do get a summons simply follow its instructions then plead your case in court.

Answer #2

get a lawyer if it was rainy and dark and the cop came out of nowhere it isn’t your fault you slowed down which was a good thing if they send you to court or give you a ticket fight it because you did nothing wrong and that cop was being a jerk you could also get him on verbal threats

Answer #3

a summons for not seeing a cop on a dark, rainy night just jumping out of nowhere?

what a git!

I dont know much about law but I would suggest you get in contact with a brief asap :)

According to the cops if you were out and there was a traffic cop you are to listen to his direction over anything else. They are viewing this as you disregarded his instruction which is against the law. And even if you hydroplaned they are going to say you were not driving the proper speed for the weather. My friend crashed her car in the winter because of ice and the cop still wrote her a ticket for not driving properly for the weather conditions. We were only going about 15 mph too. Its all based on what the cops say.

If you get a summons its not suing they are calling you to court to address the issue you had with the cop and perhaps fine you, probably nothing over a few hundred dollars tops.
