Emergency temporary custody?

How long does it takes to give emergency temporary custody of my child to my mother? Could it be done in a few hours?

It’s interesting that Mandy has seen your other questions since you just joined yesterday and have apparently only asked this one question.

Anyway, you could grant your mother temporary custody and authority to act in your behalf in taking care of the child’s welfare by creating a Limited Power of Attorney in your mother’s favor.

You don’t really need a lawyer to do it, you could look up the information on what one looks like on the internet. The main requirement is that YOU sign it in front of a Notary Public, who will Notarize it, which you can find at most any bank.

If, however, there is some legal issue regarding your child and a court or child protective agency is involved, then your mom, with your consent, could seek legal temporary custody of the child through the court.

The difference between a legal temporary custody of the child and the temporary custody and authority that you could grant threw a Power of Attorney, is that with a legal temporary custody you no longer have any responsibility for the child or its welfare whereas with the Power of Attorney method YOU would still be responsible for the child and the child’s welfare and would be required to revoke the Power of Attorney if you found that the child’s welfare was at stake.

I have some advice for you - I’ve seen your other questions.

I’m a recovering drug addict - so I know what you are going through. I did not have a child at the time of my addiction though. You are doing drugs - they have every right to take your child away from you and deny you custody until you can clean up your act. Having a child is not a right, it’s a privledge. You are showing them and everyone else that you are not capable of putting your child first - drugs are more important.

You need to clean up your act. Go into rehab and start going to NA meetings. This will atleast show the court system that you are trying to get clean and they will be more willing to give you partail custody or atleast visitation rights. If you do not go to rehab or NA meetings - you can probley kiss your child goodbye. A child does not need a druggie for a dad. You can overcome your addictions - if you try. Don’t want you to be a part of your child’s life?

the only advice I can give you, is contact a lawyer and ask.. there are lawyers who deal in only family law.. he could give you an exact time frame.
