How does this whole custody thing work out?

My dad currently has full custody of me, I think, because he took my mom to court for custody, she never showed, so it was adjourned (whatever that means). Anyways, some problems happened between my mom and me, and my dad and me, and the end result is that they have both kicked me out of their homes. My aunt is more than willing to take me. Since he has custody of me and gave me permission to live with her, can I? He said he would pay for my flight to live with her. Will there be a bunch of legal stuff involved before I can go?

Answer #1

For her to legally be your guardian, yes, there would be legal things that would have to happen.

Answer #2

Do you know what kinds of legal things?

Answer #3

I think you would have to go to like a family court, and get all that stuff sorted out. Like she would have to get papers legally stating that she is your legal guardian, and that she is responsible for your dental, health, and etc. are taken care of.

Answer #4

It is for legal ownership for who is more fit and when each member can have the child or item for so long.

Answer #5

She lives in Ontario, and I’m in Alberta. Could I move in with her, and THEN get it all sorted out?

Answer #6

This is a lot less complicated than people are making it. Yes, you can go live with your aunt. No, you don’t need to take legal action. All that is required is a note written by your dad that you’re under your aunt’s guardianship - that’s so your aunt can speak on your behalf regarding schooling, medical, etc. My daughter went to live with other people at the age of 14 so she can go to a special school … there was no legal repercussions or problems.

Thank you so much for this answer. You gave me everything I needed to know. Thanks!
