Are you protected by the First Amendment if the use of cannabis is in your religion?

Even if cannabis is illegal where you live? If not, why?

Answer #1

No you are not. I think the relevant legal precedent is set by

The U.S. Supreme Court’s Decision of April 17, 1990 in Employment Division, Department of Human Resources of Oregon v. Smith

Where different laws would give different interpretations of “legality” a precedent will determine which law is more important.

Let’s be fair, if some Ayatollah in the Middle East declares in a Jidah that …..

….. all Muslims are under an obligation of faith to kill all non-Muslim Americans, do you seriously expect that the First Amendment should give them freedom to engage in terrörism and wanton slaughter whenever and where ever they feel like it ?

Answer #2

I know native americans are allowed to smoke it legally. I used to work with some who would use it when they had their pow wows or whatever they are called.

Answer #3

You mean peace pipes?

Answer #4

Or, are you talking about their celebrations/rituals?
