My sister a teen mom

My lil sister is Due in Jan and she is 16. She hasnt decided if she is going to keep the baby or give it up for adoption so I guess I want to know where we can go to find out what her rights are if she keeps it. Like does she have full custody or can her father take over without her authorization?

I just wanted to add - make sure she gets that custody order done…if she doesn’t do it, her father can go to court for custody and if he wins, then he CAN take the baby.

He may be her legal guardian, but she is the child’s mother and that gives her precedence over her father.

He can’t take her baby, but I do recommend she talk to a lawyer nonetheless if she feels this may be a situation that may evolve. It’s better to have someone backing you up from the beginning in case he does make an attempt.

Ok someone was telling me that since he has legal guardianship over my sister since she is 16 he would also the baby so that is a relief to know that!

She doesn’t automatically have custody - she needs to go to court for that.

Without custody, the father can take the baby and walk away and she can’t do anything about it, so I strongly recommend she take the initiative and get the custody order put into place.

Oh, no …her father has no claim to the baby and taking it would constitute kidnapping.

I ment my sisters father not the babies father? Is that what you mean as well?

Also (im sure this doesnt matter now) when you have a baby (in the hospital) they give you many papers to fill out, one of which is called an Affidavit of Parentage. This paper states that the birth mother has sole custody of the baby until either the child is 18, or the matter is taken to court and decided otherwise there. I know this because I had signed one in the hospital for my son, and I never really read the papers so I had no clue until my sons father took me to court for custody and my lawyer brought it up. ( I won, or rather was able to keep my son with me). Just FYI
