Michigan car accident (no insurance)

I was moving through an apartment complex when someone backed into my car. He was clearly at fault, however I hace no car insurance at this point in time. We exchanged information, but did not call the cops (at least not yet).

My question is, if the police are called, will it be deemed my fault just because I didn’t have insurance? We came to an agreement that around 200$ should cover the damage to his car. (Neither of us were travelling fast). The damage is just behind my rear drivers side door. And on his car, to the rear driverside bumper. It’s slightly dinged up (his car, I’m not worried about mine) and there are a lot of scratches and such.

I’m looking for any advice possible., I’m collecting unemployment, and need to take the least expensive route here. Would it be cheaper for me to call the police? Is it my fault just because I had no insurance, or his fault(because if I had insurance, it would deffinitley be his fault)

I’m looking for any advice/opinions that any of you have.

I think cars moving from being parked into the traffic part of a roadway or parking lot are required to yield to oncoming traffic.

You should call your state’s Department of Motor Vehicles and find out if you are required to have auto insurance on private property, which the parking lot is. You should also find out at what dollar amount (total for both cars) you become required to turn in an accident report to the state.

Since no police report was filed around the time of the accident, I don’t think it is timely to file a report now.

He sounds clearly at fault and I don’t think I would pay him anything. He isn’t likely to report the accident either because it might increase his insurance rates and he probably knows that he would lose if he tried to take you to court.

If you have witnesses, you should get them to write a statement and give it to you.

yeah I agree with cruise2smile1 and ty. you do get fined for driving without insurance. at least you exchanged information and came to an agreement. the best thing to do here and again… pay for what you think is fair.

theres no evidence so don’t call the police, pay what you think its fair, if you think the other person is charging you too much go with the person to the mechanic and ask how much it covers.

well, the accident was comepletely his fault. He backed up as my car was passing him, he hit the rear drivers side of my car. I’m not 100% but I’m almost positive that if you’re backing out of a parking spot, you’re required to yield to all oncoming traffic. He was trying to say it was the other way around.

The fine in michigan for driving with no insurance is 200$, so that’s the most I’m willing to give him. If he tries to get more than that, I’ll just go to the police. Since the accident was his fault, I’m not required to pay for any damage to his car.

You don’t need insurance to drive or park in a parking lot.

In general you should call the police any time there is more than a few hundred dollars of damage or if anyone is hurt. Every time I’ve called the police after someone hit me they did write any tickets and did not file a report but they did take notes and gave me a business card in case I needed them to confirm the facts later.

You should keep a camera in your vehicle. After the accident take pictures of both vehicles, the location, and anything that might be a mitigating factor like poor visibility, vegetation obscuring signs, etc. My ex-father-in-law once got into an accident where the other guy actually took a different car with extensive damage in for repairs rather than the car that was in the accident with only minimal damage.

what if you are driving with no insurance and the other person hits you do you just get a ticket or what.
