All of the portable applications I’ve used up until this date have been safe. If you download one and want to be sure, however, you can upload your file to an Online malware scanner to check it out before using. Jotti has a pretty good online malware scanner (You can use the scanner here: http://funadvice.com/r/14moqcao9cd ).
When it comes to their legal status, most of them are, but not all of them. There are portable applications out there from software that you do need to pay for, so if you come across those (ex: photoshop, etc), don’t get them. Use free ones instead. If you go to download a portable application, just be sure to check that it’s an ‘open source’ one. Open source ones are free to use and are generally legal.
