Financial Companies calling everyday

I was laid off my job in July 2008 and have been looking for work, but with the economy I haven’t had much luck. My husband has had his pay cut at work and hours since I was laid off. We got behind on several of our bills and I have called to try to work with them. There is one company we have a car financed with and they are so rude, one lady even told me to get a job or borrow money. I ask them if they could re work the loan anything so we could make our payments. They did defer 2 payments in December, and they keep saying we have helped you and we can’t do anything else. We want to pay everything but when your income gets cut about 600 or more a week it’s hard and we are trying. They call 4 or times a day . Is this harrassment? Is there something more we can do to get them to work with us? It seems they are not willing to do this. I hate calling because they are so rude or answering when they call. I have actually blocked them on the phone. Can they be sued for harrassment?

Answer #1

One thing that isn’t going to help at all, is blocking them and refusing to talk to them. You do need to work with them and pay them, pay whatever you can otherwise it looks like you’re not trying at all.

Answer #2

No, they can’t be sued - it is within their legal right to take whatever measures possible to request their money.

Unfortunately, there’s not much you can do, especially considering they’ve already helped you with a couple of payments. If you don’t find a way to make your payments, you’re going to lose your car.

Here’s some excellent info on consumer rights from clarkhoward.com: …an excerpt: Collection agencies are bothering me. What can I do? We’ve been receiving a lot of questions about collection agency calls. We recommend you go to FTC.gov and read the Fair Debt Collection Practices Act so you’ll know about your rights. One word of advice: Don’t ignore the letters you receive. Answer them all, even if it’s with Clark’s “drop dead” form letter.

Take care !!
