If you are divorced I believe you can but other wise you can't I don't think

Yes, of course you can. Go to your social services office in your local town and they will give you the paperwork to fill out and tell you exactly what to do. Make sure you take ID for you and your son, just in case they ask for it at that visit. They'll send you a follow-up letter in a week or so plus probably a quick meeting to make sure they have all the information correct before filing anything, and that way you can get past payments that were possibly missed. What he owes you will come out of what little money he gets in prison plus then you'll get the rest from the government, usually, which HE will have to pay back once out of prison or find a way while in prison to do so.
